In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties published in the Official Gazette of the Federation on July 5, 2010, as well as its corresponding Regulations (in concert with the Law), Humana de Equipo y Materiales S.A de C.V located at Periferico Poniente 2507, int 7, colony San Juan de Ocotan, C.P. 45019, Guadalajara, Jalisco, extends and informs you of this Personal Data Privacy Notice for all legal purposes that may apply.

I. WHAT IS PERSONAL DATA?

It is information concerning an identified or identifiable natural person, expressed in numerical, alphabetical, graphic, photographic, acoustic or any other form, which may include, but is not limited to: (i) general data such as full name, work address and /or individual, landlines and mobile phones, tax address, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), email address (e-mail), occupation, personal references; (ii) patrimonial and/or financial data such as bank account data and interbank number (Clabe Interbancaria), bank references. From now on, the previously mentioned data will be referred to, as a whole, as “Personal Data”.

For the purposes indicated below, Humana de Equipo y Materiales S.A de C.V may request and keep copies of your official identification with a photograph, your bank account statement, proof of address and RFC ID, which will also be safeguarded with the technical, administrative and physical security measures necessary to protect your Personal Data.

II. WHAT DO WE USE YOUR PERSONAL DATA FOR?

Humana de Equipo y Materiales S.A de C.V will collect the Personal Data that you freely and voluntarily provide, solely and exclusively for the purposes of: (a) identification, (b) registration, deletion, incorporation and updating, if applicable, in the bases of data from Humana de Equipo y Materiales S.A de C.V as a Client, which will include your purchase history for purely statistical and improvement purposes in the service we provide, (c) preparation and execution of various contracts, such as purchase and sale, consignment, distribution, provision of services, among others, according to the Client’s requirements, (d) compliance with obligations arising from the legal relationship between Humana de Equipo y Materiales S.A de C.V and the Client, (e) payments, (f) Inform about changes or new products or services that are related to the product or service previously contracted by the Client and comply with its pharmacovigilance obligations (g) contact the Client personally, by telephone or by email for the aforementioned purposes and, (i) as the case may be, for administrative, judicial or any other processes involving the owner of the Personal Data.

It is important that you keep in mind that if we do not have your Personal Data we would not be able to carry out the purposes for which they are required and, in such case, we would not have any type of responsibility for their proper achievement.

Once the purpose of the processing of Personal Data is fulfilled, it will be blocked for the sole purpose of determining possible responsibilities in relation to its processing, until the legal or contractual limitation period thereof. During this period, Personal Data may not be processed and after this period, it will be canceled in the corresponding Database.

III. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

Humana de Equipo y Materiales S.A de C.V may transfer your Personal Data only to its subsidiaries and affiliates for the purposes of complying with its administrative processes of customer registration, credit history, collection, preparation of agreements, contracts, statistics, commercial analysis and control. Humana de Equipo y Materiales S.A de C.V may reveal or allow access to the Personal Data that you provide to us, to comply with applicable legislation or at the request of the competent authority. Under no circumstances will we market, sell or rent personal information about you to a third party without your prior consent.

The Personal Data that you provide us may be compiled and stored in a database exclusively owned by Humana de Equipo y Materiales S.A de C.V.

We understand that you have given your consent to the transfer of your Personal Data, having expressly stated, through signing this Notice, that there is no opposition to the same being transferred through the means that we have made available to you and made known to you in terms of this Notice.

IV. HOW DO WE PROTECT YOUR PERSONAL DATA?

Personal Data will be kept under the strictest confidentiality and cannot be used for any use other than those mentioned above, unless there is a change in this Privacy Notice.

At Humana de Equipo y Materiales S.A de C.V we have the necessary and sufficient security, administrative, technical and physical measures to protect your personal data.

V. WHAT AREA IS RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA?
